Keeping in Touch: Iowa finances encouraging

By its very nature, government tends to be reactive. This is not new. Conversely, it has been the trend for at least a century. The downside to this is the fact when something occurs  where any level of government is adversely affected, whether man or naturally induced, then the source of funds to "fix" the problem are seldom available.

Communities, counties and schools look to the state during times of shortfalls or disaster, and the state expects cooperation from the federal government. That is what occurred during the past several years in Iowa, other states and the national level. Then, with a global economic meltdown, changes in the spending habits of the populace exacerbate the problem. Unemployment grows, as capital investment in existing or intended small business and industry creation or expansion is put on hold. This is basic economics.

Add nature's wrath, whether in the Gulf of Mexico with the oil disaster, or moisture brought to the Midwest from the rotation of weather systems laden with moisture from the Gulf, or Pacific Coast fires and earthquakes that add to the cost of repair and replacement of infrastructure, and government is expected to accept the predominate burden of these costs. With that, the source of funding comes from our pockets. Needless-to-say, the last couple of years have been devastating from a national perspective.

From a provincial standpoint, Iowa is one of only eight states to win top financial marks. Eight states have received the highest possible rating, AAA, from the top three financial ratings agencies. Iowa's across-the-board AAA rating is a vote of confidence in our state's economic future. Proudly, we have the fourth best and stable state budget in the nation.

In other words, not only was Iowa's budget balanced on June 30 of last month, the last day of the fiscal year, that balance was $175 million more than anticipated by the Revenue Estimating Conference. With this, our ending balance for the fiscal year was $275 million. These extra funds will go into our cash reserves, which will top $500 million by the start of the year. Financially, Iowa is the envy of nearly all states in the nation.

With the figures all in, we find this to be very encouraging news, especially in view of the fact that the economy is not rebounding as quickly as expected. And yet, our unemployment across the state is relatively stable at about 6.7 percent. It is higher in the Jasper portion of my Senate district, but lower in the Polk County segment.

The function of the state is not job creation. Rather, the state can provide incentives, but we must strive to keep government at affordable levels. Again, by its very nature, the historic trend is for government to be all things to all people. That was not the intent of the founding fathers of this nation, for a bloated government not only thrives on taxes, but finds itself doing things for people that they were meant to do for themselves.

As a nation and state, we will succeed in overcoming this deep recession. It has not been one experienced before, because the world is far more complex with its internationally entwined financial markets and interaction. The economics I loved and excelled in at college is not somewhat antiquated. The world now operates on a different plane, and surely one in which we must learn to accept and lead. But the basic fact remains the same, whether it's our family budget or our state budget - we must learn to live within our means.

Dan Kelley wins close vote for House District 41 nomination

Dan Kelley said he expected a tight vote when he walked in the door to Thursday's special nominating convention to fill the vacancy on the Democratic ticket due to the death of long-time House District 41 Rep. Paul Bell.

And he got it.

Kelley, the Jasper County Democratic Party chairman, edged past Wes Breckenridge, a newcomer to party politics hoping to follow Bell's path from law enforcer to law creator, by receiving just three weighted votes more than the necessary threshold to win.

The final vote tally was 3,326 for Kelley to 3,120 for Breckenridge. Nominee Tracy Doonen received no votes. A total of 3,323 was needed to win.

"I anticipated the close vote," Kelley said after winning the nomination to seek the House seat. "I'd like to thank the delegates. Their faith in me means the world to me. The numbers were exactly how I expected when I came in the door."

The delegates to the special convention, party precinct committee members elected at the January caucus, were as split as they could be. Kelley received the weighted vote support of eight delegates with Breckenridge picking up support from seven. Three eligible delegates to the convention did not attend.

Interestingly, Kelley received no support from any of the Jasper County elected officials who were delegates to the convention.

Supervisors Dennis Stevenson and Rick Tiedje sent their precinct's votes to Breckenridge. State Sen. Dennis Black, Jasper County Auditor Dennis Parrott and Jasper County Attorney Mike Jacobsen also sent their votes Breckenridge's way. Former Jasper County Human Resources Director Brian Sims and former county supervisor Max Worthington also provided votes for Breckenridge.

But it was Kelley's support among party regulars, including former supervisor Jeanne Bridenstine, that pushed Kelley over the hump. He also received weighted votes from Deb Johnson, Dave Pitz, Cinday Pollard, Bill Guthrie, Dan Ingle and Kelley himself.

Kelley acknowledged the delegate split during his speech seeking the nomination and vowed that the party would leave the convention as a unified block and work toward election in November.

"To the delegates who lean a different direction, again, no looking back," he said. "We have just over three months to take our cause to the voters. Regardless of the results, we walk away from this convention unified and working together towards election day and beyond.

"Much has been said to the effect that, 'Dan deserves it. He's paid his dues. He's done the work for the party.' Delegates, as I have told you, I ask for no support simply as thanks for a job 'well done.' I simply ask that you recognize my demonstration of effective campaign and leadership skills."

In asking for delegate for support, both Kelley and Breckenridge emphasized the need for local job creation, their support for education and their willingness to work hard for the constituents of the district. Doonen, who was a late entry into the nomination quest, acknowledged that now might not be her time but vowed to "be back here sometime."

Breckenridge said he had no regrets following the close vote. He had previously vowed to run a positive campaign and felt his efforts in seeking delegate support showed just that.

"I can hold my head up high for the effort I put forward," he said.

Kelley will face Republican Party political newcomer Gabriel Swersie in the November election.

Following is a breakdown, by precinct, of the weighted votes cast. The votes represent the number of votes Bell received in each precinct in the last general election. When two party precinct committee members were selected within a precinct, each received control of half of the total votes. Four precincts within House District 41 had no representation. Six precincts within the county are not within the House district.

Breckenridge hopes to follow in Paul Bell's footsteps

Newton Police Department Lt. Wes Breckenridge hopes to follow the path of his former colleague, Paul Bell, and move from enforcing the laws to help crafting them, too.

On Tuesday, Breckenridge, a 17-year plus veteran of the Newton police force, said that he is actively seeking the opportunity to be elected to Iowa House District 41 on the Democratic Party ticket.

"With my years of public service, I feel I can utilize my education and experience to make a positive impact serving in the Iowa House of Representatives for District 41," he said.

The head of investigations for the Newton Police Department and recent public administration Upper Iowa graduate, Breckenridge said he's always had an interest in someday seeking public office, though he didn't realize the opportunity would come so quickly.

Out of respect for his law enforcement comrade, Breckenridge said he gave some time to honor Bell's passing before cold-calling local Democratic Party leadership to see if he might be a person the party was interested in supporting. And like Bell, who was a party newbie when he first sought the seat nearly two decades ago, Breckenridge said he also needed some time to get to know the process.

The first step in that process will unfold next Thursday when 18 Jasper County Democratic Party precinct committee members will decide whose name will appear on the November ballot. The precinct delegates will cast their weighted votes at special state party called meeting until a victor emerges.

Though realizing internal party politics can sometimes be marked by turmoil, the long-time registered Democrat said he has no intention of engaging in that type of activity as he campaigns for delegate support.

"I'm taking a positive approach," Breckenridge said. "I sought this out, no one approached me. I think I can do a really good job for the district and the state. I'm going to say here's who I am, I'll work my butt off for you, seek insight and input from people who have knowledge of the issues involved, keep an open mind and act independently. I hope at the end of the day they will give me a fair shake. I know I'm a newbie, but given the opportunity, and with my 20 years of public service, I think I can make a positive impact at the statehouse."

Reporter's Notebook: Serious arm-twisting going on

When 18 Jasper County Democrats meet later this month, they alone will have the power to select whose name will appear on the November ballot for the opportunity to be elected to the Iowa House District 41 seat left vacant due to the death of long-time office holder Paul Bell.

State Democratic party leaders are expected to call for the meeting of the Jasper County party precinct committee members the week of July 19 to fill the ballot vacancy existing due to Bell's death last month. The committee members were selected at the off-year caucus held earlier this year, a sparsely attended event that leaves several precincts within the district without a delegate to the decision-making process.

While one might suspect that the delegates would have an equal say in filling the ballot vacancy, such is not the case. Party rules allow for a weighted voting strength system. When the state party chair reconvenes the Jasper County precinct committee members, their vote will be "proportionate to the vote cast for the party's candidate for the office in question in the respective precincts at the last general election for that office."

Following is a list of the precinct delegates and their weighted voting strength. When two people were selected within a precinct at the caucus, they split the weighted vote.

Four precincts within House District 41 have no representation on the central committee: Clear Creek/Poweshiek, Newton 1-1, Newton 2-1 and Newton 4-2. The remaining precincts within the county are not in House District 41, generally the Monroe, Colfax and Prairie City areas.

Such a process sets the stage for some serious arm twisting by the candidates seeking to be placed on the ballot. Dan Kelley, the Jasper County Democratic party chair, who is actively seeking the seat, controls more than three times the votes of Jon Davis, 836 versus 267. Another individual who I'm told is all in is Tracy Doonen. And there's a third, whom I've told I wouldn't name until he or she has had a chance to test the waters. Others may pop up.

How all this plays out is anybody's guess at present. But be certain the delegates are hearing from the candidates and talking amongst themselves, too. And state party leaders are involved as they want a strong candidate who will be able to continue to hold the seat since the District has been in Democratic hands for as long as most can remember. (And don't forget about reapportionment early next legislative session.)

It will also be interesting to see how the state party decides to run the meeting. Are they going to allow for secret ballots, where verbal commitments can easily be broken? Or will they require an open vote, which could pose the risk of party disunity? And will the delegates be allowed to split their votes?

Finally, peeking from behind are state and local Republican Party officials. If there's a glint of damage in the Democratic armor they may propose a strike.

Keeping in Touch: New legislation effective July 1

Thankfully, the short 80-day session was spent primarily on issues pertaining to the state budget. The massive state shortfall in revenue, brought on by the global economic crash, and exacerbated by the state having to match FEMA monies for approximately $3 billion in flood damages across the state, resulted in massive across-the-board cuts. Thus, very little policy work was sought, and the budget was our priority.

Those policy issues that were passed by both Houses and signed by the governor were few. Following is the list, and frankly, I voted against a couple.

Support for Small Businesses - Focuses state job creation on small Iowa businesses instead of large Wall Street companies by increasing the Research Activities Credit available for small businesses (Senate File 2380).

Domestic Abuse - Forfeiture of guns. If a person is convicted of domestic abuse or is the subject of a permanent protective order, the person will lose the ability to own guns (Senate File 2357).

Text Ban - Drivers under the age of 18 years cannot use an electronic device while driving, unless it is installed in the vehicle or operated through permanently installed equipment. Drivers over 18 cannot use a hand-held communication device to read, write or send a text message, but can use the device to make a phone cal. The penalty for all ages is a $30 fine, with harsher penalties if in an accident with serious injury or death. Warning citations begin on July 1, 2010, and fines begin on July 1, 2011 (House File 2456).

Seat Belts - Requires all persons under the age of 18 years to use either a safety seat or seat belt unless all seat belts are already being used. If a person age 14 years or older is not using a seat belt, they will get the ticket, not the driver of the vehicle (Senate File 2381).

Military Spouse Benefits - Allows unemployment benefits for an individual who left employment because of the relocation of the individual's spouse due to a military assignment in another area (House File 2110).

Grain Weight Limit for Farmers - Allows commercial motor vehicles, other than special trucks, on non-interstate highways, to haul up to 90,000 pounds on six axles and 96,000 pounds on seven axles. Currently allowed for livestock or construction vehicles, this allows farmers to haul heavier grain on trucks with more axles (House File 2512).

Health Insurance and Cancer Trials - Insurers say they pay for routine care for cancer patients in clinical trials, but many patients are reluctant to participate fearing they will lose their health insurance. This bill makes it easier for patients to participate in these trials be assuring them that routine care will continue to be covered (House File 2075).

Mental Health Hospitalization Notification (Ed Thomas Bill) - Assures that law enforcement are notified when individuals hospitalized for a serious mental impairment are released from care if there is an arrest warrant or pending charges against the individual (Senate File 2352).

Smart Growth and Comprehensive Planning - Establishes a set of 10 comprehensive planning principles that state and local governments should use in preparing for future growth. These principles are guides and not mandates (Senate File 2389).

Right to Carry - Provides that there be continuity across the state in the issuing of gun permits to citizens, with said permits being issued by the Sheriff of each county. Note: This legislation does not take effect until Jan. 1, 2011, in order for the Sheriffs to prepare for the new internal procedures.

There were other bills that made it into law, but the above appear to be the most notable.

Announcement: Governor Culver will unveil the recently found rare copy of the Declaration of Independence on Thursday morning, July 1, at the State Historical Museum west of the capitol. I will be giving the keynote address on the history of the document. Chairs will be available, so bring a lunch and view this marvelous find. The program starts at 11:30 a.m. Following the unveiling, I will be having a book signing of my book, "Profiles of Valor." All proceeds from the sale of the book have been donated to the State Historical Society of Iowa for Civil War research and the preservation of Civil War muster records.

Keeping in Touch: First Avenue progress report

A very informative and successful meeting was held at the capitol on Wednesday morning with Tony Gustafson, assistant district engineer for the Iowa Department of Transportation District 1 Office; Keith Laube, Newton Public Works director; Sharon Tahtinen, of the governor's office; Senate transportation committee staff; and me. As promised nearly a month ago, my purpose was to bring together those involved in the eventual completion of First Avenue from Fourth Street West and on to 14th Street East. I wanted to review the plans and view the time-line of the project and report back to constituents.

In the meantime, the City of Newton, which has responsibility for surface maintenance of U.S. Highway 6 through the city, did an excellent job of filling the potholes and grouting the cracks. Naturally, this is only a temporary solution for the surface, but I'm impressed with the quality of the finished product. This temporary "fix" may last the summer and early winter, but it appears fairly certain the IDOT and Newton's Public Works Department will join in having the entire distance re-surfaced to conform with the current re-surfaced First Avenue from Highway 14 to Fourth Street West.

Some may not be award of the fact that DOT's responsibility is only with the traveled portion of Highway 6 through Newton. The city is responsible for storm sewer, intakes, curb and gutter, traffic signals and parking that exist beyond the traveled portions of the roadway. IDOT plans and specifications are beginning to be prepared for the project; and the city has but little yet to do to accomplish their design portion of the project.

A date for solicitation of bids will be set by IDOT, and the successful bidder will implement the entire project, inclusive of both city and state roadway and parking components.

In a communication from IDOT on Wednesday afternoon, I was informed that their management team has scheduled an internal meeting on July 15 in Ames for a review of the department's five-year transportation program. This is the first step in the process to possibly add the project to the current DOT five-year transportation program which will be considered by the DOT Commission in the fall of 2010. Mr. Gustafson stated that the U.S. Highway 6 project in Newton will be discussed.

However, for the present, IDOT District 1 engineers will continue with their activities in anticipation of meeting a late winter bid letting (February or March 2011), with the intention of construction in 2011. The contract time requirements can be set up to not allow the contractor to work during busy downtown activities.

I departed the joint meeting with full confidence in the IDOT and Newton's Public Works Department as having developed a legitimate plan, and a timetable (weather permitting) that would prove highly beneficial to the traveling public and inner city commuters. I have no doubt that IDOT is fully aware of Newton's need for a top quality corridor through the city, not only for conventional transportation needs of the citizens to work and obtaining goods and services, but also in showcasing the community in our objective of being a great place to live, work, raise a family, and provide for the needs of yet unknown small business, industry and tourism.

It will come. Frankly, a year from now, I would anticipate the project possibly being completed.

Reporter's Notebook: Who will the Democrats pick?

Local Democrats find themselves in a situation they haven't faced in decades - finding a candidate able to keep House District 41 on the Democratic side of the aisle.

The situation arises, sadly, due to the passing of Rep. Paul Bell, the former Newton cop who held the seat for 18 years after it was handed to him when former state lawmaker Glen Jesse made an ill-advised run for Congress. Bell's strength locally made him a shoe-in election-after-election.

His death, however, is likely making the state Democratic Party leadership a little nervous about holding the seat this fall, especially with the current voter mood.

So, later this summer Jasper County Democrats will need to convene to pick a replacement to run for Bell's House seat. So who will it be?

The top of everybody's list is Jasper County Treasurer Doug Bishop. His previous work with the UAW while at Maytag and his long involvement in the local and state party - as well as such little intangible things like organizing an Honor Flight to take Jasper County war veterans to view the memorials in Washington, D.C. - make Democratic party leader's drool.

The only problem is that the arm twisting going on behind the scenes isn't going to budge him (at least for now) from staying right where he's at - comfortable in his county elected position.

"I'm very honored that people have asked me to seek the seat, but I'm at a very good point in my life right now," Bishop said. "I have great staff here at the Treasurer's Office and am able to enjoy time with my family. I'll leave that opportunity for the future."

OK, so who else might be out there? Ah, how about the Newton mayor? Like Bell, Chaz Allen would be able to hold the seat for years and years. And he's soon going to be out of a job. Perfect.

Nope. Not going to happen. Let's just say he does better work from the outside in.

Who else? I mentioned Mr. Jesse earlier - an experienced state lawmaker and former county supervisor. Only problem is he lives outside District 41. Scratch him off the list.

How about one of the Gannons from up near Mingo - strong party activists for years? Nope. Maybe Rick Tiedje, the Jasper County Supervisor stepping down after one term? Nope. Joe Brock? Nope. John Parsons? Nope.

One person who I think would be a good candidate and would represent the county well would be Nancy Parrott. She's been with the party since forever, runs unopposed for County Recorder every four years and is in a position where the paltry legislative salary that turns so many off would not be a factor. I'm told, however, that she's not interested.

So, unless somebody else comes out of the woodwork, it appears that the local party's current chairman, Dan Kelley, will be selected to run for the open seat this fall. He's the only one who has expressed interest, is fairly well known due to all his volunteer work with a variety of organizations in the community and has been active with the local and state party for a number of years.

Should that outcome materialize prior to the Aug. 13 deadline for party's to set their tickets, what will be interesting to see is how the local Republican Party reacts. Will they keep Gabriel Swersie or put up someone a little better known in the county in an attempt to take a seat that has been comfortably in Democratic control for decades?

Keeping in Touch: A sad week

Last week was a sad one for us all. I still have difficulty realizing my friend of many years, Paul Bell, is no longer with us. I have set my mourning aside, and force myself to think of the good and productive times we had together. Our overseas travel was always a success in moving Iowa farm products to foreign markets, and during the 15 years of our endeavors, we developed friendships abroad that resulted in Iowa quality products becoming well-known to meat and grain commodity buyers.

Paul worked hard at the capitol. Being an avid fisherman, he was especially pleased to be named as the Chair of the Natural Resources Committee. Many good laws that were advantageous to Iowa's outdoor sporting men and women made it through his committee to the governor's desk. We always discussed the ramifications of this legislation before his taking action.

Paul especially enjoyed having constituent school classes visit the capitol. We would join in providing tours, relating the history of Iowa's seat of government, and ensuring that each visiting group would have their picture taken in both the House and Senate. He will be missed, and his colleagues in the House of Representatives considered him a most conscientious legislator.

Another loss was that of Bill Watt. Perhaps better known as the husband of Uncle Nancy, I always referred to Bill as the "gentle giant." Bill was a Vietnam veteran and had a heart of gold. As a member of the Veteran's Committee in the Senate, we talked often, and he urged me to work to have Iowa as the first state in the nation to accomplish the task of passing all 10 veterans laws that were proposed by the Department of Veterans Affairs. Accepting the challenge, we were able to accomplish that task on virtually a bi-partisan basis. Iowa became the first state to do so, and during floor debate on the final action of the final bill, I spoke of our accomplishment for which I knew Bill, ravaged by Agent Orange, would be proud. I called them "Bill's bills."

Another tragedy occurred with the passing of Don Byers. Don and I were friends of many years, and served on several boards and committees together. Although of different political persuasions, and Don very committed to his ideology, we never let that stand in the way of working to make Newton a better place. A complete resume of Don's accomplishments could almost make a book. He was selfless in giving his time to the community whenever called upon for leadership.

We shared a special accomplishment, and one which today's generation is undoubtedly unaware. During the mid-'80s, the east/west line of the Rock Island Railroad, which passes through Jasper County and Newton, declared bankruptcy. The near-term probability was that the right-of-way would be sold, leaving Newton with no means for rail transportation of appliances and receiving raw materials for appliance manufacture. Don called me at the capitol and asked if I thought the legislature could come up with $15 million to assist private enterprise in purchasing the rail line from Council Bluffs to Bureau, Ill. I immediately arranged a meeting with then Governor Branstad, and a group comprised of Maytag, Rollscreen and shippers of agricultural products from elevators across the state. The governor was amenable to the project, but the availability of the $15 million was virtually an impossibility. Don, always bold and analytical in his thinking, suggested transferring the funds to the Iowa Railroad Finance Authority from the road-use tax fund, constitutionally protected for roads and bridges. IRFA would legitimize the action as a temporary loan and the "Iowa Interstate Railroad" would retire the encumbrance. Following review by legal minds, I and a couple other legislators authored the bill, and the legislature passed the plan on a bi-partisan basis.

Iowa had now saved the railroad, and Don Byers stood by his commitment to the General Assembly to pay back the loan. That was accomplished in just a few years, and to this day, the railroad moves massive amounts of coal, grain and hard goods across the state. I would dare say it was one of our greatest accomplishments as a government/private joint endeavor.

All shall be missed. Their contributions to society were different in scope, but each left a lasting legacy. Their passing once again reminds me of the necessity that we must always advise those who give their time and effort to causes of good a pat-on-the-back, and a serious "thanks" for their friendship and good deeds. Yet, human nature is to render accolades of endearment only after someone departs.

Democratic convention members will select Bell's replacement

Delegates to the Jasper County Democratic Party convention will meet later this summer to determine who will run in Rep. Paul Bell's stead for the House District 41 seat in the November election due to his death on Monday.

Only those delegates representing areas in the county within District 41 will make the determination.

A candidate needs to be certified by Aug. 13.

Whomever is selected will run against Gabriel Swersie of Newton, who ran unopposed on the Republican ballot on Tuesday.

Black to face old foe Pirillo in Iowa Senate race

Sen. Dennis Black, D-Lynnville, will face an old foe in the November election for Senate District 21 with Joe Pirillo of Altoona winning the three-way Republican primary race.

Pirillo, who lost to Black in a Democratic primary in 2002, switched parties to gain the nomination for the seat that includes most of Jasper County and the eastern quarter of Polk County. The long-time Altoona councilman received 44 percent of the votes cast to outdistance GOP candidates Wes Enos and Michael Adams Jr., both of Bondurant in Tuesday's vote.

The long-time Lynnville lawmaker said he looks forward to a "spirited" campaign.

"I congratulate Joe for his win in the Republican primary," Black said. "We have been opponents on the ballot before, so I'm confident we will both engage in a spirited campaign. My campaign will be issue oriented, and I will continue to work on job retention and job creation. Small businesses are the basis for the largest number of job creation opportunities. I am not a supporter of chasing large corporations with taxpayer money, only to have these 'rent-a-companies' hit the road when the incentives run out.

Keeping in Touch: Small business, the key to recovery

Jobs created by Iowa's small businesses are the key to our state recovering from the national recession. As I've stated numerous times, Iowa's small businesses are the "backbone" of the state's economy. Significant changes are on the horizon that will result in a greater state commitment to assisting small business owners by reducing impediments, providing access to low-interest loans and grants, and in 2011 going back to the rate level of unemployment compensation tax, which along with reduced income taxes, will be conducive for savings that should enhance a small business owner to consider expansion and new job creation.

Coming out of this two-year recession is difficult for all, and devastating for some. Iowa was more fortunate than most states, for state savings in the emergency and "rainy-day funds were extremely helpful in reducing the need for additional cuts to services. Education suffered, and in some areas of the state, additional property taxation was the only means where districts with little or no reserves could cope with the across-the-board cuts. I totally opposed that action, and thought the legislature could do a better and far more responsible job by reconvening in a special session and making spending cuts that would be less destructive to the family budget.

I've consistently voted to fund the Mid-Iowa Small Business Development Center in Urbandale, which serves Polk and Jasper counties. This center is part of a statewide network that helps start and grow small businesses. Each of the centers across the state works directly with small business owners, as well as with local chambers of commerce, community colleges and other organizations.

According to a independent study by the University of Mississippi, clients of Iowa's Small Business Development Centers grew 3.5 times faster than the average Iowa business in the last three years. At the same time, these small businesses were creating and saving almost 4,000 jobs; increasing statewide company revenues by $240 million; and raising $77 million in new investment dollars.

Last week I mentionedmy objective of talking face-to-face with engineers and annual program planners with the Iowa Department of Transportation regarding the asphaltic surfacing of an additional segment of Newton's First Avenue. That opportunity will occur this coming Tuesday in Ames. I was informed that potholes would be filled, and every effort made to have the street less hazardous prior to this weekend's events. With all the cars that will be in Newton on Friday and Saturday, the temporary repair will be appreciated and essential. However, the state needs to accept the responsibility of moving quickly to finish the surfacing of their highway. Newton's economy is stressed enough without having to wait much longer for non-bone rattling access to downtown from the east.

Rep. Paul Bell askedthat I extend his love and appreciation to all who have exhibited their concern and prayed for his recovery. One of my closest friends of three decades, Paul has gone through a lot over the past nine months. I was so highly impressed that even with his chemo and radiation treatments, he never missed a day of the past legislative session. He is a fighter and seeks to beat this dreaded disease.

Keeping in Touch: Nothing ventured, nothing gained

I attended a meeting at DMACC on Thursday at noon, and following a conversation with a couple of ladies regarding the condition of First Avenue East, I decided to drive the distance from Fourth Street West to 25th  Street. As readers well know, excluding just a couple of areas, the worst conditions are currently from Fourth Street West to 14th Street East. I knew First Avenue was bad, but I quickly found out the abnormal winter and spring had substantially deteriorated First Avenue and was shocked to note the extent of the weather-related damage. I generally do not take this route when entering Newton. Frankly, that stretch of First Avenue is embarrassing. True, it's better than horse-and-buggy days, but not for modern vehicles. Frankly, I find it rather incredulous that IDOT would consider that stretch of state highway through Newton as "average."

So, I decided to stick my neck out and next week will drive to Ames after arranging a meeting with Department of Transportation officials regarding the potential of an overlay for that reduced distance. Now, keep in mind this is a shot-in-the-dark, and in fact may prove futile. However, nothing ventured, nothing gained. Also keep in mind that the suggestion will be to overlay this segment only in 2010, with the remainder from 14th Street East to 25th Street being completed in 2011.

My evaluation of the distance was that the first segment was in need of overlay as quickly as possible. We can live with the third segment for the year, but next year would be a "must." My hope is the state will go for the three-year approach, as they turned their back on finishing up the entire distance from 4th Street West to 25th Street East this year.

Naturally, I will report to the local media my success or failure at IDOT. I am aware that money is in short supply following the tremendous amount of road use tax funds needed to repair flood-ravaged roads in the eastern part of the state. But at the same time, a portion of the funds derived from the legislature's bonding of 2009 and 2010 for the I-JOBS program was to be used for "horizontal infrastructure." At least I'll learn just how serious "they" were in using that money for job creation.

Regarding a totally different subject, I want to express my gratitude to Doug Bishop and his organizing crew for the phenomenal job they did with the "Honor Flight" for WWII and a few Korean War veterans. I was asked to participate in the program, and did so by raising money, and by bringing Marine Sgt. Major Brad Kasal, a native of Afton, Iowa, back from Camp Pendleton, Calif., to present the keynote address. Sgt. Major Kasal is thought to be the most decorated soldier from the Iraq/Afghanistan Wars. Our friendship goes back many years, and he was honored to make it home and speak to the WWII veterans and others present. Sg. Major Kasal is the recipient of the Navy Cross, second only to the Medal of Honor, along with seventeen other decorations, including two Purple Hearts.

His deed of valor for the Navy Cross, the highest award presented to date to any living soldier of Iraq/Afghanistan Wars, came from forcibly entering a house in Fallujah, where three of his men were being held captive by insurgents. In doing so, he took seven AK-47 hits to his body, two of which virtually severed his leg. He was able to dispatch the three enemy with his 9mm side arm. However, one still managed to toss a grenade at Kasal's feet. The Sgt. immediately moved on his remaining leg and stood as a shield in front of his men. With the grenade to his back, the resulting explosion sent 42 shrapnel into his back, buttocks and leg. The lives of those Marines, several of whom were wounded, were saved by his selfless act of intrepidity.

Virtually drained of blood, Sgt. Kasal was moved to a nearby unit infirmary to receive five pints of blood. Following a week in a German hospital, he spent a full year in Bethesda Naval Hospital, and to date, has received over 20 operations. His leg was re-attached, and other than bits of shrapnel that continually move to the skin surface, his recovery is nothing short of a miracle.

Sgt. Major Kasal currently commands 6,000 Marines at Camp Pendleton. We were in communication on Thursday, prior to his flight back to California, and he committed to returning on Aug. 17 and 19 of this year to again serve as the keynote speaker to two additional Freedom Flights. These two are again being sponsored by Hy-Vee, Casey's and Prairie Meadows. I have been asked to assist in the coordination of these events, and thus urge any remaining WWII veterans who read this column to get in touch with me at your earliest convenience. Enos leads GOP campaign finance race in Senate District 21 primary

Wes Enos holds the campaign finance edge in the three-way Republican primary race for Senate District 21, state reports filed last week indicate.

Enos, the former political director of former Arkansas Gov. Mike Huckabee's Iowa caucus effort, reported cash contributions of $3,405 for the reporting period, far outdistancing his two rivals in the primary, Joe Pirillo and Michael Adams Jr.

And Enos' political connections to the former presidential candidate were shown in two donations that amounted to about a third of the total. Enos reported a $500 campaign donation from Huckabee himself and another $500 contribution from Huck PAC of Little Rock, though the donation was returned and itemized as an expense "due to the timing of the original contribution," the report states.

Enos reported total expenditures of just more than $1,800 leaving him with about $1,600 in cash on hand heading toward the June 8 primary.

Pirillo, who previously ran as a Democrat in a primary challenge to the Iowa Senate district's incumbent, Dennis Black, reported cash contributions of $600 with expenditures totaling approximately $400.

Adams reported cash contributions of just under $400 with expenditures totaling about $390, leaving him with $10 cash on hand. He also reported in-kind contributions of $215, most of it for web design services.

The three will face off in the Senate District 21 primary race for the right to face Black in the November election. Though Senate District 21 encompasses nearly all of Jasper County and just the southeast portion of Polk County, all three Republicans hail from the Des Moines area with two from Bondurant and one from Altoona.

Black, a Democrat from Lynnville, reported campaign contributions of $6,650 for the reporting period and another $11,885 from in-kind contributions. He recorded expenses of just more than $2,000 leaving him with $18,600 in cash in hand as heads into the fall election. Black is not opposed in the primary.

While there is no contested primary for Iowa House District 41, incumbent Rep. Paul Bell, D-Newton, and his November Republican challenger, Gabriele Swersie of Newton, filed campaign finance reports that show Bell with a significant monetary lead.

Bell reported campaign contributions totaling $7,350 for the reporting period and expenditures of about $2,700 leaving him with approximately $12,900 heading into the fall campaign.

Swersie reported contributions of $2,470 with nearly half of the total coming from Newton resident Claudia Springer's $1,000 cash contribution. He reported only $75 in expenditures.

Keeping in Touch: State's ash trees in danger

A week ago, the Des Moines Register had a front-page story on the Emerald Ash Borer being discovered in the northeast corner of Iowa. This is an insect invasion we had expected for several years, and in fact, knew it was inevitable.

I always serve on the Natural Resources Appropriations Subcommittee in the Senate, and annually we would appropriate funding to the Department of Natural Resources, Forestry Division, to place and periodically inspect insect traps in the northeast part of the state. This area was selected, for across the Mississippi River in Wisconsin, the Emerald Ash Borer had been discovered in a load of firewood, and then a year later, in several trees in an adjacent campground. Now it's crossed the Mississippi and will most likely continue in its westward movement. Illinois, Minnesota and Missouri have also identified localized infestation.

Historically, we have experienced similar situations, although the Emerald Ash Borer rivals the chestnut blight where, according to Wikipedia, "3.5 billion chestnut trees (were killed)." There are an estimated 3.5 billion ash trees in Ohio alone! Also noted from the same source, "200 million elm trees" were killed by the Dutch elm disease. It is estimated that the Emerald Ash Borer could decimate the nation's ash population, comprised of three species, being black, green and white ash. The normal range of the borer is Russia, Japan and China, with experts suspecting the insect arrived in the U.S. in shipping containers.

Iowa foresters say that ash is the predominant shade tree in Iowa. After the Dutch elm disease killed the rows of trees along city streets and in resident's yards, the ash was often the replacement. The tree is hardy, relatively fast growing and in open areas develops a full canopy. The tree is very adaptable to most conditions across the state, and becomes well established for beauty and shade.

Normal movement of the Emerald Ash Borer across Iowa will be sporadic and relatively slow, if by natural means. However, should ash fire wood be transported anywhere in the state and have borer eggs or larvae in the bark, the population of the insect will rapidly escalate in that area. Then, the borer will move outward, in all directions, from that point of infestation. If lucky, we could have a decade before it arrives in central Iowa by natural means. If transported, it could be here anytime!

The borer itself is actually a beautiful colored insect, being a deep, iridescent green, about 12 mm (1/2 inch) long and 4 mm wide. The eggs are laid in the bark of the ash tree, close to the leaves which are devoured by the insect itself. The bark entry hole for eggs is in the shape of a "D," rotated with the flat side horizontal. The larvae are white.

Should any readers ever observe the insect or the unique hole in the bark of one of your ash trees, modern chemical products have been proven effective. However, there's little need to be concerned at this point, but just know that someday they will arrive. Being ready can significantly assist in an environmentally safe method of treatment, allowing one to inject the chemical into the tree at its base. Topical spraying is NOT necessary.

I'm confident the Forestry Bureau of the Department of Natural Resources will come to the legislature this coming session for enhanced funding to contract with Master Arborists in an attempt to stop or slow the movement of the Emerald Ash Borer. And, you can rest assured that research and application of that research is under way on additional methods of treatment, both chemical and biological.

Keeping in Touch: Iowa, a place to stay

The large post card that was sent to computer selected constituents during the legislative session resulted in an inordinately high percentage of return. Strangely, some continue to trickle in after months, so I will wait a few weeks before releasing the complete results. However, I feel it appropriate to advise readers that the number one issue listed in responses was "jobs" and "strong schools."

Iowa's economy and creating jobs are obviously at the forefront of citizens' minds. Yet, the best thing the state and most often do when it comes to job creation is to simply step aside and not create any more impediments to the free-enterprise system. To do so ultimately results in fewer jobs being created. It is not the role of the state to create jobs, but rather provide public policy which allows an individual(s) to fulfill their dream of self-employment, creative investment, job creation and worker/staff selection, supply (production), to meet product or service demand and finally, to eventually create a profit. That is what America and our economic system is all about.

Clearly, a key element in the story of job creation is directly tied to education and a dedicated work force with a strong work ethic. If starting from scratch, this would take time. However, Iowa is known for its strong and exceptional community and private colleges. It is the role of state government, for the sake of property tax control, to invest in the educational aspect of job creation. And that is why it is so difficult for state appropriations for K-12 education and community colleges to be reduced. They certainly were this year, but the adverse impact anticipated by so many did not materialize to the expected degree. I generalize when reporting that most schools did as they were urged, and that was to utilize a portion of their reserve funds to make up for reduced state assistance. Along with the local school boards implementing their own spending reductions, I have full confidence it will eventually work out.

This is not to imply that school boards had an easy task, or even had reserve funds to utilize in making up a portion of the shortfall. In fact, many did not. Thus, one of the final acts of the legislative session was to provide an additional $100 million in "backfilling" to school districts to lighten the burden of inevitable budget cuts. Strangely, the legislation passed on a party-line vote. I considered it a good vote, for it was one where the state reduced the impact of the governor's 10 percent across-the-board cut. The infusion of that sum of money into the budgets of school districts across the state saved a good number of educators from being laid off, class sizes being increased, and eventual and substantial increases in property taxes to replace the loss in state aid.

Anyone who thinks that "job creation" and "education" do not go hand-in-hand should talk to the job creators in the free-enterprise system. They are linked to a degree that it's little wonder Iowa is selected as one of the best state's in the nation to start a business and do business. Forbes Magazine just provided those accolades for Des Moines and for Cedar Rapids, and in doing so, recognized the state for its highly skilled and educated workforce.

Newton will be receiving its own national recognition, anticipated to occur just any day. Such notoriety is great for the city and the state. News of this magnitude registers with those seeking a central-state location for expanding or creating new business. Newton and Jasper County have so much to offer to entrepreneurial endeavors. Mark my words ... they will come, and sooner than you think.

Our local economy is improving, and in fact, there are many prospects being considered and pursued at this very minute. Some will materialize, because of the recognition that this is where good things happen. I hear so often about the ills of Iowa from the inevitable doom-sayers, only then to think of how neat this state really is. Great people, low crime rate, fantastic schools, wonderful public and private colleges, the crossroads of the nation, the food basket of the nation, superb public safety with police and fire protection. I could go on and on. The greater the economic environment, the sooner the transition of attitudes as to the value of the state as a place to live, work and raise a family. What's better than that?

Keeping in Touch: Bills from the session reviewed

Few Iowans are aware that this summer alone, over 3,000 of our citizen-soldiers will be deployed to Afghanistan. Add to that those deployed prior to now, and those this fall and early winter, and we could easily approach close to 5,000. My daughter-in-law, a member of the Guard, was supposed to go in March, but with a year-old baby, was transferred to the regular Army Reserve and will serve homeland clerical and logistical arrangements.

The U.S. Department of Defense had requested each state to work towards the adoption of 10 legislative objectives that pertained to the "quality of life" for the soldier and his/her family. As a member of the Veteran's Committee in the Senate, our initial meeting in January was comprised of a discussion about the challenge of our meeting that goal, and work to ensure that all 10 were passed and sent to the governor. We accomplished that objective and all 10 were signed into law by the governor.

A legislative news release best described the breadth of the legislation: "From unemployment to housing to family services and legal protections for service members, these commonsense proposals became law because Iowans will always support those who defend our freedoms."

I will not go into detail about all 10, but if a reader is interested in such, call or e-mail me and I will get you a copy of the actual language in the legislations, along with a simplified synopsis of all 10.

Grandparent's rights?

What is more special to a strong, committed familial relationship than grandchildren? We have five, and have no restrictions visiting our grandchildren, nor they with us, often staying overnight on the "farm." Unfortunately, such is not the case with all families. Conflict, for whatever reason, occasionally results in children's alienation with their parents or in-laws, and thus they refuse to allow grandparents the joy of association with their grandchild(ren).

I receive dozens of calls and e-mails each year from grandparents who seek state legislation that would establish a "Grandparents Bill of Rights." Unfortunately, it is not all that easy, and in many aspects impossible, for under Code Chapter 598B and court precedent, the decision as to whom children can associate rests solely with the parents, and if a parent(s) is deemed unfit, then placement and visitation options are vested with the courts.

This session, the legislature did act where they could tread in SF 2306 by striking the current grandparent visitation law, Code Section 600C.1, and made changes that enhanced the opportunity for some grandparents to interact with their grandchildren/great-grandchildren. The actual law is true legalese, but not to the point where it is not understandable by most.

I'm totally confident the reader wonders why it is necessary for the legislature to mess around with this. Why not just require parents to share their children with the grandparent/great-grandparents? Why does the state have to get involved? I understand that frustration, for I constantly hear it from heartbroken grandparents. But not every situation is the same; and the law is very specific under Chapter 598B, the Uniform Child Custody, Jurisdiction and Enforcement Chapter.

But in the end, should you have a case for which joint resolution is unattainable or acceptable to DHS or the courts, chances are an attorney should be retained to represent your case before a judge for review and decision.

Again, my column for at least the next month will deal with a few of the non-budget legislation that passed and was signed into law. Later, I will have a column or two on budget legislation, and attempt to explain the rational for passage of some seemingly questionable spending.

Keeping in Touch: Using common sense

The 2010 legislative session ended a month ago, and the period since has been as hectic as any I've experienced. The governor waited until the final day to sign five appropriations bill, and from what I understand, very little was "line item" vetoed. All legislation passed during a session has to be either signed or vetoed within 30 days of the close of the session. Therefore, I will spend a day at the capitol with the appropriate staff, and find out exactly what transpired by the governor's action.

There were fewer bills passed during the 79-day session than ever before. There's a good message there! Perhaps shorter sessions to address budget bills and appropriations to services provided by cities, counties and school districts, along with less emphasis on policy creation, would make for a more productive session. However, there has to be extensive attention directed to interim studies on an overhaul of tax policy in Iowa, the school aid formula, flood plain management and perhaps other high-dollar aspects of the state's revenue and spending.

On Thursday, I decided to drive over to Cedar Rapids. I wanted to see, first hand, what real accomplishments had been made with the billions of state and federal dollars that have been spent to restore the city. I was pleasantly surprised to see business returning to the lower southeast business community. Yet I was rather taken back by the fact that "restoration" appears to be viewed by many as progress and therefore success. I even stopped a couple of folks on the street, gave them my card, and asked their opinion on what is occurring. One, a policeman, was very outspoken with sincere concern about the fact that nothing appears to be done to make sure "we never have another flood like this again." No one can make that promise, because reality is it will happen again.

Ron Corbett, former Speaker of the Iowa House and a native of Newton, is the Mayor of Cedar Rapids. Being on a fact-finding and personal observation mission, I went to his office. Unfortunately he was out, but I managed to talk with several folks in city government that agree with my assessment that chances increase with each passing year that cities like Cedar Rapids will experience devastating floods. Why? Not because of any climate change, but rather because of land-use change. That is the absolute key factor in why Cedar Rapids, Iowa City, Des Moines and many other cities have soaked up billions in state and federal tax dollars to repair and replace damaged infrastructure and assist with rebuilding business and homes in the same location and manner as previous to the flood.

Land-use planning and changes in how the land is used to coincide with the adopted plan is essential to avert another financial "black hole" for taxpayers across the state. At least a major portion of the land in the watershed above the city has to be converted back to some standard of how it was. Continuing to allow building of streets, parking lots, and remove the native vegetation for lawns, golf courses and other "beautification" in a watershed, will only ensure that the "sponge" that heretofore stored the water from snow melt and cloudbursts can once again serve that purpose. There is no other answer! Levies, dikes and similar structures eventually fail; allowing water to stay on the land where it falls will save untold billions.

In conclusion, on the drive home I reflected on my day in Cedar Rapids, and fear that if there is only little change in where and how building occurs in the 100-year flood zone of the watershed, then chances are great a flood disaster will occur again. Yet, it is difficult for a city wishing to enhance its tax base to say "no" to building permits in flood prone areas. As I've stated before, I don't want the state or federal government to again have to bail out those unfortunate home and business owners that have not learned their lesson. Rather harshly put, I just don't think it's the state or feds' role to continue to bail out stupidity.

Commencing next week, I will provide a brief synopsis of bills that passed the legislature and became law with the governor's signature.

Culver stop in Newton today cancelled

Dan Kelley, chairman of the Jasper County Democratic Party Central Committee, announced moments ago that Gov. Chet Culver has cancelled his visit to Newton later this afternoon.

Culver had been scheduled to make a campaign stop at Uncle Nancy's Coffeehouse at 3:30 this afternoon.

Kelley said the Culver campaign gave no reason for the event's cancellation.
