A Cedar Rapids woman filed suit against the Iowa Speedway on Thursday claiming the "dangerous condition" of the parking area at the Newton racetrack caused her to fall and injure herself.
Angela Roorda, in the lawsuit filed in Jasper County District Court, claims that while returning to her vehicle following a June 20, 2010 race at the facility "she stepped into an unmarked opening in the ground causing her severe injuries."
Roorda claims she fell even though she "was exercising due care for her own safety" at the time.
"Defendants knew, or in the exercise of ordinary care, should have known that the condition of the property created a dangerous condition which could not be noticed or detected by persons using the defendants' premises," the lawsuit states. "Defendants were negligent in the care and maintenance of their property so as to allow a condition to exist which presented a hazard to customers and invited spectators, such as Plaintiff, while using Defendants' premises for a racing event and business purposes."
Roorda claims that as a result of her fall, she suffered "serious, severe injuries, pain and suffering, medical expense, loss of function of a body part, permanent impairment" and that she will continue to suffer from the fall into the future.
She is seeking damages in excess of $5,000.
