The attorney for the Newton woman charged with the alleged theft of funds from the American Legion is asking the court to dismiss one of the charges filed against her, a move county prosecutors are resisting.
James Nelson, the attorney for Shari Good, filed a motion on Tuesday to dismiss the charge of ongoing criminal conduct against Shari Good saying the charge is duplicative of the first degree theft charge she also faces and violates the double jeopardy clause of the U.S. Constitution.
Good was charged following an audit of the American Legion's finances. She is accused of misappropriating more than $10,000 from the veteran's club.
District Court Judge Darrell Goodhue has scheduled a hearing on the motion to dismiss for Nov. 16. Good is scheduled to stand trial on the charges on Dec. 16.
